Libya Enforces New Administrative Regulations for Trademark Law
Libya has made an important step towards strengthening intellectual property rights in the country, as the Libyan Minister of Economy issued on 1/24/2024 Resolution No. 26 of 2024, which includes the implementing regulations for Chapter One of Book Ten of the Commerciaal Activity Law No. (23) of 2010 AD, regarding Trademarks:
The new implementing regulations include comprehensive frameworks for practical and legal handling with trademarks. This decision aims to create a structured approach to the registration and management of trademarks in Libya.
Among the important provisions of the implementing regulations, we mention the following most important points:
1- Electronic filing of trademark application is applicable via a special platform that will be announced later.
2- Registration of audio marks is applicable.
3- Adoption of the 11th edition of the Nice International Classification
4- If the mark includes one or more words written in a language other than Arabic, it must be legally translated into Arabic altogether with the Arabic pronunciation.
5- If a specific color is not designated to the mark, registration is only valid for the black color.
6- Electronic Publication of the trademarks has become in effect.
7- Reducing the objection period from 60 days to 30 days
8- Increase the official fees at the Trademark Office
