Kuwait Issues Decree-Law No. 147 of 2025 on Powers of Attorney
Kuwait has issued Decree-Law No. 147 of 2025, introducing updated provisions regarding the notarization and validity of powers of attorney.
The law stipulates that, except for commercial agencies and cases exempted by the Minister of Justice, powers of attorney shall not be notarized for five years unless a shorter period is agreed upon or the power of attorney ends for any reason. The notarization must include the expiration date, and the end of the notarization period does not affect the legal validity of the power of attorney between the parties.
Additionally, powers of attorney with an unspecified duration established before the enforcement of this decree-law will remain valid for two years from its effective date or until the power of attorney expires, whichever comes first.
This decree-law enhances legal clarity and ensures consistent regulation of powers of attorney in Kuwait
